The President's attorney Michael Cohen said last month he paid Ms Daniels, whose real name is Stephanie Clifford, $US130,000 of his own money ahead of the 2016 election in exchange for her silence over an alleged relationship with Mr Trump.

Daniels flouted the restraining order and sued Trump last week, contending that the nondisclosure agreement should be voided because Trump never signed it.

So, assuming the NDA is found to be valid, Daniel's should be able to breach it if she is prepared to pay the $1 million in the liquidated damages it specifies.

However the latest development has seen Stormy offer to return a $165,000 payment she reportedly received from Trump's lawyer in 2016 not to discuss the alleged relationship.

As part of the lawsuit seeking to declare the non-disclosure agreement null and void, Mr Avenatti released a copy of the alleged settlement.

Clifford could be subjected to a $1 million penalty if she broke the nondisclosure agreement she signed. The letter from Avenatti says a condition of Clifford's offer is Trump and his attorney will not take legal action to stop the interview from airing.
